§ 1. General provisions
- The Giveria service, available under giveria.com and its subdomains, is operated by Giveria - Damian Sztwiertnia, a sole proprietor. Tax ID (NIP): 5482768994; REGON: 541926891. Address: ul. Juliana Smulikowskiego 4A/21, 00-389 Warszawa, Poland.
- Contact the Service Provider at [email protected] or by post at the address above. Gameplay support is also available on the official Giveria Discord. Communication is available in Polish and English.
- In these Terms: Service means the Giveria website and game services; Service Provider means the business identified above; Administration means the Service Provider and authorised support; User means a person using the Service; Account means an individual player account; TC means virtual Tibia Coins used within Giveria, separate from currencies in other games; Consumer means a person entitled to consumer protection under applicable law.
- These Terms govern Accounts, gameplay, user content, the shop, complaints and contact with the Administration. Conduct rules also apply to official Giveria community channels.
- Registration and basic gameplay are free. Purchasing TC or additional benefits is optional. These Terms are available free of charge before registration and may be saved or printed.
§ 2. Technical requirements
- The website requires an Internet-connected device, an up-to-date browser supporting JavaScript and necessary cookies, and an active email address. Blocking required features may prevent login or ordering.
- Gameplay requires a compatible client provided by Giveria and the requirements stated with the download. Users are responsible for securing their devices and access credentials.
- Infrastructure attacks, unauthorised access, interception of other users' data and website automation that overloads the Service or bypasses safeguards are prohibited.
- CaveBot is not prohibited in general. Its use in the game is allowed under genuine player supervision as described in § 7. Full AFK CaveBot and the other expressly listed abuses remain prohibited.
- The Administration addresses faults and may perform necessary maintenance. Planned downtime is announced in advance where possible. Technical interruptions do not exclude liability or User rights under mandatory law.
§ 3. Content safety
- Unlawful content, threats, racist content, incitement to violence, fraud, phishing, malicious links and material infringing copyright or privacy are prohibited.
- Harassment, persistent abuse, disclosure of other people's non-public personal data, spam and advertising outside the appropriate channels are prohibited. Reasoned criticism, complaints and exercising legal rights do not in themselves breach these Terms.
- The Administration may remove or restrict content that breaches these Terms and apply the measures in § 6. Decisions must be proportionate to the nature and seriousness of the violation.
- Reports should be sent to the Service Provider by email or to support. Include the content, location and time of the incident, reasons and available supporting material. Provide contact details to receive a response. Never submit passwords or full payment card details.
- Reports are reviewed within 14 days. Reporters providing contact details receive acknowledgement and an outcome. Affected users may appeal under § 6. A report is information to investigate, not automatic proof of a violation.
§ 4. Registration and Accounts
- An Account is required to play. Registration involves completing the required form and accepting these Terms. The free Account agreement is concluded when the Service successfully creates the Account.
- Users must provide accurate details, use their own email address and protect their password. Impersonating others or the Administration and sharing Accounts with third parties are prohibited. An official character transfer is not a sale of the entire Account.
- A person without full legal capacity must obtain their legal representative's consent to use services or make purchases where required by law.
- Users may terminate their Account by contacting the Service Provider. Account verification protects against unauthorised deletion. Account deletion does not require deletion of data that must be retained by law.
- Account termination, a purchase complaint and withdrawal from a contract are separate actions. Users retain the rights described in § 10 and § 11.
§ 5. Use of the Service
- Users must follow these Terms, the intended purpose of Service features and applicable law. Fraud, stealing access, deliberately falsifying reports and destabilising the Service are prohibited.
- Character and guild names must not contain racist, sexually explicit or profane content or suggest Administration privileges. The Administration may require an inappropriate name to be changed.
- Rankings and profiles display gameplay information such as character names, levels, guilds and achievements. This does not authorise players to disclose other people's private information.
- Characters with rebirth 0 or 1 that do not log in for a full year are subject to automatic deletion. Higher-rebirth characters are not affected by this cleanup. This rule does not forfeit statutory claims relating to purchases.
- Ordinary competition and PvP within game mechanics are allowed. They do not justify privacy violations, threats, harassment or other expressly prohibited behaviour.
§ 6. Account restrictions and appeals
- For a violation, the Administration may issue a warning, mute, required name change, jail, temporary suspension or permanent Account ban. It considers seriousness, consequences, intent and previous violations.
- The table below sets out sanctions for the listed violations. Measures for other violations must be proportionate and justified. Criticism of the Administration or submitting a complaint is not grounds for a ban.
- Where there are reasonable grounds to suspect a serious violation, an Account may be temporarily restricted during an investigation. The Administration explains the reason and scope and investigates without undue delay. A lasting sanction requires a finding based on evaluated material.
- Investigations may consider gameplay and transaction logs, support observations, correspondence, and the authenticity and context of screenshots or recordings. An unverified allegation or lack of a player response alone does not establish a violation. Reporters' personal data may be protected; the affected player receives an explanation sufficient to respond without disclosure of other people's data or security safeguards.
- Appeals may be sent to [email protected] or through the official Discord, identifying the character, ban date and explanation. The Administration reviews appeals within 14 days. Appeals do not exclude complaints or proceedings before a competent authority or court.
- A ban does not automatically extinguish statutory rights relating to purchases. New prohibitions or stricter penalties do not apply retroactively to earlier conduct.

§ 7. Giveria gameplay rules
- Supervised CaveBot is allowed. The player must be present, genuinely supervise the character and be able to respond personally to Administration checks. An alarm or an automatic reply alone does not count as supervision.
- Full AFK CaveBot is prohibited: leaving a character to gain experience or loot, complete tasks or perform other activities without genuine player supervision. Bypassing AFK checks, including automatic replies that simulate presence, is prohibited. Passive training using designated server locations and mechanics is not covered by this prohibition.
- Actively playing more than one character at the same time is prohibited. This includes hunting, events, PvP, bosses, missions and tasks. Additional characters may use designated training mechanics but cannot simultaneously participate in active gameplay.
- Bug exploitation, duplicating items or currency, deliberately causing crashes, bypassing safeguards, and creating or using scripts that automatically approach or click Random Reward Boxes are prohibited. Permission to use CaveBot does not override these prohibitions. Report discovered bugs to support, for example through Ctrl+Z in the game.
- Following to gain or leech experience is prohibited. Follow must not be used to disrupt another player's hunt without a skull. Following with a skull for genuine PvP is allowed, but not as a pretext for experience leeching.
- Deliberately blocking Private Exp, missions or weekly quests, including Hero Envoy and RPG Island Missions, and littering Temple, the depot or publicly accessible houses are prohibited.
- Persistently preventing partnered streamers Vicantara, Gxshi, Zero, Balonik Boży, Logistyk and Bez Serca from streaming is prohibited. Ordinary PvP is allowed; this protection does not apply when the streamer deliberately engages in PvP combat. Persistent disruption may result in jail for the stream, or until Global Save for repeated disruption.
- Trade scams and fraud in trust-based games are prohibited. Casino bots are not allowed in the depot. Any activity outside the depot must still comply with the law and the prohibitions on fraud and RMT.
Trading and Real Money Trading (RMT)
- Offering, advertising, buying, selling or brokering Accounts, characters, TC, items or in-game services for PLN, other real-world currencies, cryptocurrencies, real Tibia Coins or assets from other games and servers is prohibited. This includes attempted transactions and payments arranged outside the game, including on Discord, messaging services or listing websites.
- Permitted player trading uses Giveria currency and items through the available game systems. Character transfers must use the official character sale system in the Service. Gifts, loans or seemingly legitimate trades must not be used to conceal RMT.
- The private RMT prohibition does not cover purchases directly from the Service Provider through the official shop or official exchange offers described there. Players have no right to cash out TC or resell them for real-world payment; this does not affect statutory complaint and refund rights.
Chat channels
- Advertising: trading items and houses for in-game assets and advertising characters already listed in the official character sale system. This channel is not for conversations or RMT.
- Team Search: finding groups for hunts, missions, quests, tasks and bosses, and permitted quest services. Help: questions and answers about Giveria. World Chat: respectful conversation, without trade advertisements.
- Only streamers themselves may advertise their own streams on World Chat or Advertising, at most once every 30 minutes. Stream advertisements in Temple are prohibited. Casino advertisements, where lawful and otherwise permitted, must not appear more often than once every 15 minutes.
- Spam, racism, sexually explicit content, harassment and disclosure of other people's private data are prohibited, including during personal disputes. Misusing a channel may result in a mute.
§ 8. Purchases within the Service
- The shop offers TC and additional benefits described in each offer. Before purchasing, Users should check the selected server, Account, benefit, price and any applicable duration.
- A purchase grants access to specified game features or resources. It is not an investment or deposit and does not transfer ownership of the Service, its infrastructure or copyright in the game.
- Ordering and fulfilment are governed by the offer and the separate purchase terms available for the selected payment method. This information should be available before confirmation of a paid order.
- Delivery follows payment confirmation within the period stated in the offer. For missing or incorrect delivery, contact the Service Provider with the transaction identifier and Account.
- Where an offer provides 30 days of VIP from activation, this means calendar time, not 30 days spent logged into the game. Choosing not to play does not pause the period. This does not affect rights under § 10 and § 11.
- Server closure. The Service Provider may decide to discontinue the server for justified organisational, technical or economic reasons, particularly a sustained decline in player interest that prevents continued operation. Users will receive appropriate advance notice of a planned closure, taking the terms of ongoing contracts into account.
- Once the server permanently closes, access to gameplay, characters, items, TC and progress on that server ends. Users do not acquire a right to indefinite server operation or to transfer characters or resources to another server.
- If the server closes, payments for paid extensions are not refunded unless a refund is required by mandatory law. The Service Provider does not offer voluntary buybacks of characters, items or progress, or payments for time spent playing alone. These provisions do not exclude the rights described in § 10 and § 11.
§ 9. Prices and payment methods
- The price and currency displayed in the order summary before payment apply. The price includes applicable taxes; any additional costs must be disclosed before purchase.
- Monetary payments in Giveria are processed through HotPay and PayPal. Available methods and transaction details are shown in the purchase form.
- Separate purchase terms: HotPay (PL), HotPay (EN), PayPal (PL), PayPal (EN). Payment operators' terms also govern their own payment services.
- Suspected payment fraud may lead to transaction verification and justified protective Account restrictions. Exercising statutory complaint or withdrawal rights, or using a payment operator's dispute procedure, is not in itself a violation of these Terms.
§ 10. Complaints
- The Service Provider is responsible for contractual conformity of supplied benefits. Complaints may be sent to [email protected] or by post to the address in § 1.
- Include information identifying the Account and order, a description of the problem, when it occurred and the requested remedy where possible. Screenshots may help verification but are not a condition of the right to complain.
- A response will be provided within 14 days of receipt on a durable medium, such as email. Statutory consequences of failure to respond to a Consumer complaint within the required period apply.
- For non-conforming digital content or services, Consumers may request that conformity be restored. Where provided by law, they may also request a price reduction or terminate the contract, particularly where the lack of conformity is serious or has not been remedied as required by law.
- Any refunds due follow statutory procedures and deadlines. Consumers may contact a consumer ombudsman, a competent alternative dispute resolution body or a court. Information about assistance is available on the UOKiK website.
§ 11. Right of withdrawal
- The 14-day right of withdrawal does not apply to paid digital content supplied without a tangible medium where all required conditions have been met: the Service Provider began performance with the Consumer's express prior consent, informed the Consumer of the loss of the right of withdrawal, the Consumer acknowledged this information, and the Service Provider supplied the required confirmation on a durable medium.
- Accepting these Terms when registering an Account does not replace the consent and confirmation required for a particular purchase. The exclusion applies only to benefits for which the conditions above have actually been fulfilled.
- For services, loss of the right after full performance and payment for performance begun at a Consumer's request before the withdrawal deadline are subject to statutory conditions. Activating a time-based service is not the same as fully performing it.
- In other cases, Consumers generally have 14 days from conclusion of the contract to withdraw without giving a reason. Send a statement identifying the contract to the email or postal address in § 1 before the deadline; no specific form is required. The offer and separate terms linked in § 9 describe each purchase, subject to mandatory Consumer rights.
- Following valid withdrawal, any refund due is made within 14 days of receipt of the statement, normally using the same payment method. Users must not continue using a benefit covered by withdrawal. Complaint rights in § 10 remain separate.
§ 12. Personal data protection
- The personal data controller is Giveria - Damian Sztwiertnia, with contact details in § 1. Send data-related questions and requests to [email protected].
- Account and transaction data are processed to perform the contract, comply with legal obligations and pursue legitimate security, abuse-prevention and legal-claim purposes. Accepting these Terms does not authorise unrestricted use of personal data.
- Data must be limited to what is necessary. It may be shared with hosting, technical and payment providers as needed to supply services, and with legally authorised authorities. Use of PayPal, HotPay or Discord is also subject to those services' privacy information.
- Data is retained as needed to operate the Account and subsequently to the extent and for the periods required by law or necessary to establish, exercise or defend legal claims. This does not mean unlimited retention of all gameplay history.
- Subject to the GDPR, Users have rights of access, rectification, erasure, restriction, portability and objection. Consent may be withdrawn where processing relies on it. Users may complain to the Polish data protection authority, the President of UODO. Data necessary to operate an Account is required for that service.
- Necessary cookies may support sessions and security. Non-essential cookies require separate information and consent where legally required; acceptance of these Terms does not replace that consent.
§ 13. Intellectual property and virtual assets
- Rights to code, graphics, trademarks, music and other material belong to their respective rights holders. These Terms do not claim third-party rights for Giveria or transfer such rights to Users.
- Accounts, characters, TC and items are elements of a digital service maintained within the Service. Users receive a right to use them within the contract and game rules, not ownership of infrastructure or an unrestricted right to trade them outside the Service.
- Unlawful copying, distribution, bypassing safeguards and use that infringes rights holders' rights are prohibited. Statutory exceptions and other legally permitted uses remain unaffected.
- Time spent playing or a player's own valuation of a character does not by itself oblige the Service Provider to buy the character or exchange resources for money. This does not exclude claims arising from the contract or mandatory law.
§ 14. Final provisions
- Matters not covered here are governed by applicable law, including the Polish Civil Code, electronic services and consumer rights legislation, and the GDPR. Choosing Polish law does not deprive Consumers of mandatory protection in their country of habitual residence.
- Changes to these Terms may be needed for legal, security or Service-functionality changes or to remove ambiguity. Their scope must relate to the stated reason. For ongoing contracts, the Service Provider supplies the wording, reason and effective date on a durable medium with appropriate notice, normally at least 14 days, unless law requires a different procedure.
- Changes are not retroactive, do not remove acquired rights and cannot eliminate statutory protection. Where a change requires User consent, publication on the website alone does not obtain it. Rights to terminate a contract following changes are governed by applicable law.
- Disputes are heard by the competent court under applicable law. An ineffective provision does not invalidate the remaining provisions where they can lawfully continue to apply.
- These Terms are provided in Polish and English. Both versions describe the same rules; discrepancies should be reported to the Service Provider. No provision restricts mandatory rights of Consumers or other persons entitled to corresponding statutory protection.
